2. كنوانسيون ملل متّحد در مورد حقوق كودك [1] از ميان اسناد متعدّد و مختلف نظام بينالملل حقوق بشر كه براى ممنوعيّت مجازات بدنى كودكان شناخته شدهاند، پيماننامه حقوق كودك جامعترين مورد براى چنين تفسيرى است. اين كنوانسيون كه اساس تفكّر بينالمللى براى بهبود، حمايت و تأمين منافع كودكان است، در 20 نوامبر 1989 م توسط مجمع عمومى سازمان ملل متحد تصويب شده، و تاكنون 192 كشور بدان پيوستهاند و فقط دو كشور سومالى و ايالات متحده آمريكا مقاومت كرده و آن را نپذيرفتهاند. [2] با اين حال، مىتوان گفت: مفاد كنوانسيون حقوق كودك و قسمتهاى وابسته به آن، در مواردى كه مورد اجماع و يا به طور كلّى، مورد پذيرش كشورها قرار گرفته، به صورت قاعده بينالمللى عرفى در آمده [3] و حتّى براى كشورهاى غير عضو
