آزادى‌هاى اساسى است. مادّه‌ى 3 اين كنوانسيون به بحث ممنوعيّت شكنجه، و ديگر رفتارها يا مجازات‌هاى غيرانسانى، بى‌رحمانه و ظالمانه مى‌پردازد. [1] دادگاه و كميسيون اروپايى حقوق بشر، محتواى اين مادّه را توسعه داده، و تنبيه بدنى كودكان را داخل و در محدوده‌ى اين مادّه قرار داده است؛ و بيان داشته است تنبيه و مجازات بدنى كودكان نقض مادّه‌ى 3 به شمار مى‌رود. [2] به عنوان مثال در قضيه كارِن وارويك‌ [3]- كه مدير مدرسه او را در حال سيگار كشيدن در محوطه مدرسه مشاهده كرد، و به همين خاطر او را مورد تنبيه بدنى قرار داد و با عصا به كف دستش زد.- پس از آن‌كه مادر كارِن از طرح دعوا در محاكم محلّى نتيجه نگرفت، به دادگاه اروپايى حقوق بشر شكايت كرد؛ دادگاه اروپايى اين عمل را نقض مادّه‌ى 3 دانسته، و چنين عملى را يك رفتار تحقيرآميز و غيرانسانى‌
